Provisions of the Danish Administration of Justice Act on lawyers' rules of professional conduct 

 

All our attorneys are subject to the supervisory and disciplinary system of the Danish Bar and Law Society and to the rules of professional conduct set out in the Danish Administration of Justice Act. 

The Council of the Danish Bar and Law Society supervise compliance with the requirements of the Danish Administration of Justice Act through annual inspection visits. This ensures high standards and ethics in the practice of law.

 

Legal ethics imply: 

 

  • that all attorneys and employees of HaugaardBraad are under a duty of non-disclosure and may not disclose information obtained through their employment
  • that we avoid conflicts of interest, such as situations in which advising a client might conflict with other interests.

Insurance  

 

In accordance with the rules governing membership of the Danish Bar and Law Society, all the attorneys of HaugaardBraad Advokatpartnerselskab have the mandatory professional indemnity insurance and have provided the requisite guarantee so that their professional indemnity insurance covers all legal practice conducted by the law firm in Denmark.

Insider rules 

 

All our employees are subject to internal rules that comply with the requirements of the applicable law on insider trading. The objective of the rules is to prevent insider trading, and they include a ban on the disclosure of insider information relating to listed companies and restrictions on trading in listed securities. 

 

 

Managing client funds 

 

HaugaardBraad Advokatpartnerselskab manages client funds in compliance with the rules of the Danish Bar and Law Society. Client funds are deposited in client accounts with Spar Nord Bank A/S and are protected up to a maximum amount of EUR 100,000 per client in compliance with the Danish Depositor and Guarantee Fund Act. The cover includes clients' deposits in their own accounts, in separate client accounts and in omnibus client accounts. 

Special rules apply to deposits relating to real estate if the property has been used for or is primarily intended for non-commercial purposes. In such a case, amounts of up to EUR 10 million are covered for a period of 12 months after the amount was deposited in the account, irrespective of whether the funds are in a separate account. Public and insurance-backed legal aid 

 

When taking on new cases, HaugaardBraad Advokatpartnerselskab investigates the possibility of obtaining free legal aid out of public funds or legal assistance backed by insurance for a client and informs the client of its findings. 

If legal fees are temporarily or conclusively paid for out of public funds or by an insurance company, HaugaardBraad Advokatpartnerselskab will inform the client about the principles of fixing fees and any consequences this may have for the client.
